Acceptance and recognition

FreshEvent® offers a revolutionary online platform for creating, designing, sending, and distributing personalized web invitations within the my.freshevent.io platform (“the Platform”) and the freshevent.io commercial website (the “Website”). By using our service, regardless of how you access it—by computer, through a mobile phone or other wireless or internet-enabled device, or otherwise—you agree to these terms and conditions. In addition, when using particular features on or through the Service, you will be subject to the posted policies and guidelines applicable to those features, including the terms and conditions applicable to features provided in conjunction with any of our content and service partners. All such rules and guidelines are hereby incorporated by reference into these terms and conditions. If you do not understand or agree to these terms and conditions, you may not use our service or register for an account. By using any or all of the Service or completing any registration or purchase process within the Service, you agree to be bound by all of the terms and conditions set forth herein and by the Privacy Notice, which together with these Terms of Service, create a binding contract between FreshEvent and you.

Personal use eligibility

The use of the service is not valid in places where it is prohibited. By using this service, you declare and guarantee that you have the right, authority, and capacity to accept and comply with these terms and conditions. Any person of legal age in their country of residence may use the platform freely.

Users older than 14 and under the age of majority according to their country of residence may register on FreshEvent only under the supervision of a responsible adult or legal guardian. The adult, of legal age in their country of residence, will supervise the creation of the digital invitation and ensure that the minor understands how to use the platform under their full responsibility.

Responsible privacy

FreshEvent respects the privacy of our users, and we strive to be transparent about our privacy practices. FreshEvent’s policies regarding information collected from or about you that identifies an individual or relates to an identifiable individual, and what information FreshEvent-affiliated third parties collect from you, are determined by the current regulations in force in each user’s region.

Service description

USER REGISTRATION

You must register on FreshEvent if you wish to:

– Use the design services on the Platform.
– Access your account and private management panel.
– Send a web invitation to your guests.
– Download guest registration information.
– Save and access stored information.
– View and edit your custom designs.
– Upload photos, videos, or multimedia content.
– Purchase or acquire any product from FreshEvent.

Please note that not all of the functions mentioned above may be available at any given time, and FreshEvent may require registration for additional features that may be developed or added to the Service from time to time. Unless otherwise stated, you do not need to register with FreshEvent if you are simply responding to an invitation or browsing the FreshEvent Service.

To register on FreshEvent, you may be asked to provide a valid email address, which will be used as your unique identifier for your account. You will also be asked to set a password. You may also be asked to provide certain additional information, including a picture, interests, or other requested information.

You are solely responsible for keeping your password and account information confidential. You agree not to transfer your email address or password, or lend or otherwise transfer the use or access to the service to any other person. You are also solely responsible for all activities conducted through your account. You can change your password or any other account information at any time by following the instructions available on your profile page.

PURCHASES ON THE PLATFORM

The user who makes the purchase of any FreshEvent service declares that they are of legal age in their country of residence, that they are the legal owner of the payment method used, and that the purchase is made entirely voluntarily. To acquire any service, it is mandatory to be of legal age according to the laws in your country of residence. If any problem or doubt arises, it is important to contact the FreshEvent team immediately to receive the necessary assistance.

Due to the nature of FreshEvent services and the fact that they are highly personalized digital products, any purchased product or service will not be refundable or returnable, except in exceptional cases of force majeure, previously communicated and justifiable, or due to unlikely errors of the platform itself. Payments can be made in the currency available according to the user’s country. By making any purchase on FreshEvent, you automatically accept these terms and conditions.

ABANDONMENT OR MISUSE

If you have not accessed your personal FreshEvent account for a period of at least two years, you are deemed to have permanently abandoned it, and your account will be automatically deleted, along with all related information and content. FreshEvent may terminate and delete your account at any time if it detects repeated misuse, any content deemed illegal, or a violation of the current terms and conditions.

FUNCTIONAL COMMUNICATIONS

By registering and using FreshEvent’s services, you and your third-party affiliates agree to non-commercial functional communications, preferably via email, to facilitate use and allow for the proper functionality of FreshEvent (communications regarding welcome to registration, guest confirmations, internal operations, purchases made, news, and technical support).

FreshEvent may send you notices by email, posting on the Service, or other reasonable means. You must send FreshEvent written notices by email or other expressly provided means. FreshEvent may transmit, distribute, or display notices or messages through the Service to inform you of changes to these Terms of Service, the Service, the Privacy Policy, or other important matters. Such transmission, distribution, or display of information shall constitute notice to you.

Links to third-party sites

The Service may provide, or third parties may provide, links to other websites or Internet resources. Because we have no control over such sites and resources, you acknowledge and agree that we are not responsible for the availability of such external sites or resources, and we do not endorse and are not responsible or liable for any content, advertising, products, services, or other materials (collectively, “Third Party Materials”) on or available through such sites or resources.

You acknowledge that such external sites generally have their own terms and conditions, including privacy policies, over which FreshEvent has no control, and which will govern your rights and obligations with respect to your use of such third-party products, services, or websites.

Restriction of use of content

The user acknowledges and agrees that they are solely responsible for all content (including, but not limited to, images, music, texts, videos, or other files) that they upload, enter, or use within FreshEvent.io. By uploading any content, the user expressly represents that they hold the necessary rights to such content or have previously obtained the appropriate licenses, permissions, or authorizations from the legitimate rights holders. FreshEvent.io shall not be directly or indirectly liable for user-submitted content or for any infringement of intellectual or industrial property rights arising from such content.

Modifying the Content or using the Content for any purpose other than the use of the Service, including using such Content on any other website or networked computer environment, is strictly prohibited. Unless expressly authorized by us in writing in advance, you agree not to reproduce, redistribute, sell, modify, rent, lease, lend, adapt, translate, create derivative works based (in whole or in part) on, decompile, reverse engineer, disassemble, or otherwise reduce all or part of the Service, including the Content.

The user also acknowledges that FreshEvent is not responsible for the misuse of multimedia content provided and uploaded by the user themselves, and that such content remains entirely under the user’s legal responsibility.

You are solely responsible for any data, text, software, sound files, images, photographs, graphics, videos, messages, files, links, or any other materials (“Materials”) that you transmit, post, or distribute through the Service, including, but not limited to, content in your emails, information, reviews, user ratings, photos, or images posted or submitted by you to or through the Service. All Materials posted or submitted by you are your sole responsibility. By posting or submitting Materials, you represent and warrant that you own all rights, title, and interest in such Materials and any images contained therein.

FreshEvent does not control the Materials posted or submitted through the Service and, as such, does not guarantee the accuracy, completeness, or quality of such Materials. By using the Service, you understand and agree that you may be exposed to Materials posted by other users that may be offensive, indecent, or objectionable.

Own intellectual and industrial property

We respect the intellectual property rights of third parties and ask our users to do the same. We may, in appropriate circumstances and at our discretion, terminate the accounts of users who infringe the intellectual property rights of third parties.

The resale of products or services purchased on FreshEvent is strictly prohibited, except with the express authorization and permission of FreshEvent. Their reproduction, distribution, modification, public communication, or any unauthorized use is prohibited without the express written consent of FreshEvent. All rights reserved. Modification of the terms and conditions

FreshEvent reserves the right to modify these Terms of Service at its sole discretion, and any modifications will be effective immediately upon posting. We will announce any such changes by posting the revised draft of these Terms of Service on the Service.

You can determine when these Terms of Service were last revised by referring to the “Last Updated” legend at the top of this page. Your continued use of the Service after such changes constitutes acceptance of those changes. If you do not agree to these Terms of Service or any changes to them, do not continue to use FreshEvent.

Legal and jurisdictional matters

The digital service of the FreshEvent platform is controlled and operated by the software and logistics company MEDITERRA SOLUTIONS SL, and is intended for worldwide use. It is not meant to subject FreshEvent to the laws or jurisdiction of any territory other than its own. Those who choose to access the Service do so on their own initiative and are responsible for complying with all local laws, rules, and regulations. We may limit the availability of the Service, in whole or in part, to any person, geographic area, or jurisdiction at any time and at our sole discretion.
